Terms of Service for BW Global

These Terms of Service (“Terms”) govern your use of BW Global’s services, including the mobile app, website, and any other products or services provided by Bankway Global (“Services”). By using our Services, you agree to these Terms. If you do not agree with any of these Terms, do not use our Services. This document constitutes a binding agreement between you (the client) and Bankway Global (BW Global), and by continuing to use our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.


1. Introduction

1.1 Purpose: These Terms govern the use of services provided by Bankway Global, including wallet management, currency exchange, crypto transactions, global remittances, and other financial solutions. 1.2 Scope: These Terms apply to all users of Bankway Global’s mobile app and website. 1.3 Binding Agreement: By accessing or using our Services, you agree to comply with these Terms. This agreement forms a legally binding contract between you and Bankway Global (BW Global).

2. Eligibility

2.1 Age Requirement: You must be at least 18 years old to use our Services. 2.2 Geographic Restrictions: Our Services are available worldwide, except where prohibited by law. 2.3 Prohibited Persons: You may not use our Services if you are on sanctions lists or involved in illegal activities, including fraud, money laundering, or terrorism-related activities.

3. Accounts and Security

3.1 Registration: You must provide accurate, complete, and up-to-date information during the registration process. 3.2 Account Security: You are responsible for maintaining the security and confidentiality of your account, including login credentials. 3.3 Password Protection: Use strong passwords, keep them confidential, and avoid using the same password across multiple platforms. 3.4 Inaccurate Information: Providing inaccurate information may result in account termination and payment holds. 3.5 Payment Holds: Providing inaccurate information or violating our policies may lead to payment holds, ranging from 60 to 180 days, or permanent holds. 3.6 Violation Review Process: In the event of a violation, we will follow a review process that includes account termination, a violation review, and the opportunity to challenge the decision via email (review@bank-way.com). 3.7 Final Decision: The decision made after review is final and cannot be challenged in any court of law.

4. Verification

4.1 Mandatory Verification: Verification is required before you can use our Services. 4.2 Verification Requirements: You must provide accurate and valid identification documents for verification. 4.3 Forgery: Submitting forged documents will result in permanent account bans and payment holds. 4.4 Additional Information: We may request additional information at any time without notice. 4.5 Verification Failure: Failure to complete verification may result in suspension or termination of your account.

5. Payments and Financial Transactions

5.1 Payment Methods: We accept various payment methods for transactions, including credit cards, debit cards, bank transfers, and crypto payments. 5.2 Fee Changes: We reserve the right to modify transaction fees at any time. 5.3 Payment Processing Timeframe: Transactions may take from 10 minutes to 15 days to process, depending on the payment method. 5.4 Payment Disputes: If a dispute arises, it must be reported within 15 days. If unresolved, it will be investigated, and a resolution will be provided within 90 days. 5.5 Payment Failure: Bankway Global is not liable for any payment failures caused by third-party payment processors or external systems.

6. KYC (Know Your Customer) Compliance

6.1 KYC Process: As part of compliance with financial regulations, we require users to complete KYC verification before using certain Services, such as withdrawing funds. 6.2 Document Verification: KYC documents must be submitted in their original form and be valid. 6.3 Failure to Comply: Failure to complete KYC verification will result in account suspension or termination.

7. Intellectual Property

7.1 Ownership: All intellectual property rights, including trademarks, logos, and content on Bankway Global, are owned by us or our licensors. 7.2 Content Usage: You may only use content provided by us for personal, non-commercial purposes. 7.3 Restrictions: You may not copy, modify, distribute, or create derivative works from the content provided by Bankway Global without our prior written permission. 7.4 Trademarks: Our trademarks, logos, and branding are protected by law and may not be used without permission. 7.5 User-Generated Content: You grant us a license to use any content you submit to our platform as necessary to provide our Services.

8. Disclaimer and Limitation of Liability

8.1 No Liability: We disclaim liability for damages resulting from:

  • Service interruptions or delays.
  • Losses caused by using third-party services.
  • Consequential or indirect damages. 8.2 Indemnification: You agree to indemnify and hold Bankway Global harmless from any claims arising from your use of our Services. 8.3 Dispute Resolution: All disputes will be resolved by Bankway Global’s governing body. Our decision is final. 8.4 Governing Law: These Terms are governed by the laws applicable in the UAE or jurisdiction where Bankway Global operates. 8.5 Opt-Out: If you disagree with these Terms, you may choose to discontinue using our Services.

9. Termination

9.1 Termination Rights: We may suspend or terminate your account without notice if you violate these Terms. 9.2 Non-Contestable Termination: Our decision to terminate your account is final and cannot be appealed. 9.3 Termination Timeline: If your account is terminated, all decisions regarding suspension or termination will be finalized within 180 days. 9.4 No Liability for Termination: We are not liable for any consequences of account termination.

10. Governing Body

10.1 Jurisdiction: These Terms shall be governed by the laws of the UAE. 10.2 Dispute Resolution: Any disputes will be resolved in accordance with Bankway Global’s internal policies. 10.3 Amendments: We reserve the right to amend these Terms at any time. All updates will be communicated via email or our website.

11. Communication

11.1 Electronic Communication: We communicate with you electronically through email, in-app messages, and notifications. 11.2 Notice Period: We will notify you of any critical changes to these Terms at least 3 days in advance. 11.3 Language: All communication will be in the language selected during registration.

12. Amendments

12.1 Changes to Terms: We may update these Terms periodically. Updated Terms will be posted on our website and sent via email. 12.2 Continued Use: Continued use of our Services after changes signifies your acceptance of the revised Terms.

13. Severability

13.1 Invalid Provisions: If any provision of these Terms is found to be invalid, the remaining provisions will continue to apply. 13.2 Replacement Provisions: Invalid provisions will be replaced by valid provisions that reflect the intent of the original clause.

14. Withdrawal Method Verification

14.1 Additional Verification: Users from high-risk countries must undergo additional verification to use certain withdrawal methods. 14.2 Deposit Requirements: A specified deposit must be made to verify the withdrawal method. 14.3 Non-Compliance: Failure to meet verification requirements will result in account termination.

By using our Services, you acknowledge that this Terms of Service constitutes a legally binding agreement between you, the user (the "Client"), and Bankway Global (BW Global). You agree to adhere to all the terms laid out in this document. Bankway Global reserves the right to modify, suspend, or terminate access to the Services at any time, with or without notice, in case of a violation of these Terms.
